Introduction

The following privacy policy governs the collection, use and processing of any Personal Data disclosed or made available by you to BISTEC Care.

Note that, unless otherwise specifically defined, any terms and expressions utilized in this Policy shall have the definitions ascribed to them in the BISTEC Care Platform’s Terms of Use (accessible here: https://www.bisteccare.lk/terms-of-use/).

The term or expression, “Policy”, as utilized herein, means and refers to this privacy policy, as may be amended from time to time - including any terms and conditions incorporated therein by reference as well as any annexures thereto.

By registering and creating a User Account on the BISTEC Care Platform or otherwise making Personal Data available to BISTEC Care, you hereby:

• Acknowledge and undertake to be bound by and adhere to all of its terms and conditions.
• Consent to the processing of your Personal Data as outlined in this Policy.
• Consent to receiving informational, promotional, and advertising material and communications from BISTEC Care.
• Acknowledge and agree that the collection and processing of Personal Data is necessary for the operation, administration, and development of the BISTEC Care Platform.
• Acknowledge that the Program and its features are not intended for minors under the age of eighteen (18).

IF YOU DO NOT AGREE TO OR COMPLY WITH ANY OF THE TERMS AND CONDITIONS INCLUDED IN THIS POLICY, PLEASE REFRAIN FROM REGISTERING WITH AND CREATING A USER ACCOUNT ON THE BISTEC CARE PLATFORM OR FROM ACCESSING AND / OR USING THE BISTEC CARE PLATFORM, ITS FEATURES OR ANY OF THE SERVICES AND PRODUCTS OFFERED BY BISTEC CARE IN CONNECTION THEREWITH.

The Categories of Personal Data Collected for the Purposes of the Program

The term and expression, “Personal Data”, for these purposes, is broadly defined as information that identifies or distinctly relates to a particular natural person. Note that BISTEC Care may collect and process a variety of Personal Data for specific uses, including, but not limited to:

• Account information
• Practice information
• Personnel information
• Client information
• Contact information
• Device information
• Job and task related information
• Any other information that you voluntarily provide

The BISTEC Care Platform may also use cookies, web beacons, unique identifiers, and other technologies to track user activity.

The Purposes for which Personal Data are Collected and Processed

Any Personal Data collected by or on behalf of the Operator may be processed and used for one or more of the following purposes:

• Facilitate and operate the BISTEC Care Platform, its features, and integrations with Integrated Platforms.
• Identify, contact, and communicate with User(s).
• Develop, personalize, and improve the BISTEC Care Platform.
• Protect against legal liability and resolve disputes.
• For fraud prevention and verification purposes.
• For promotional purposes across all mediums of communication.
• For internal record-keeping, analytics, archiving, and statistical purposes.

Note that certain categories of Personal Data may be displayed publicly on the BISTEC Care Platform.

Right to Procedure for Prospectively Withdrawing Consent

You may revoke the consent granted by you to BISTEC Care, provided that any revocation or withdrawal of such consent shall:

• Be made by way of a written request submitted under and in terms of Clause 6 below.
• Not affect the lawfulness of any processing which occurred prior to such revocation taking effect.

Maintaining Up-to-date Personal Data

You represent and warrant that any Personal Data provided to BISTEC Care is true, comprehensive, and accurate. You also undertake to promptly update such information.

Note that BISTEC Care does not independently confirm or evaluate the accuracy or comprehensiveness of any Personal Data provided and relies solely on the information provided by you.

Rights of Data Subjects

If you have any clarifications or complaints regarding your rights as a data subject and this Policy, you may contact the Data Protection Authority of Sri Lanka. Please also familiarize yourself with Part II of the Personal Data Protection Act, No. 09 of 2022.

Where any User wishes to submit a request to BISTEC Care for the purposes of exercising any rights conferred on him or her under the Act, such Request:

• Must be in writing and delivered by email from the email address registered and maintained by you with BISTEC Care.
• Shall be subject to the fulfillment of any counter-requests made by BISTEC Care for the purposes of establishing your identity.
• Must fairly and accurately identify the Personal Data in respect of which such Request is being made.
• May be processed subject to the advance settlement by you of such fees as may be prescribed by regulations made under the Act.
• Shall, if granted, be processed and fulfilled subject to a processing period of no less than ninety [90] days.

This Policy shall be governed by and construed in accordance with Applicable Law (as defined in our Terms of Use).

The BISTEC Care Platform may contain links to other sites, services, and applications that are not operated by us. Users acknowledge and agree that BISTEC Care has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party sites, services, or applications.

The terms and conditions of this Policy are subject to change and modification by and at the absolute discretion of BISTEC Care. Any amendment or modification shall only take effect after it is posted at https://bisteccare.lk/privacy-policy/.
